I just got one today, may 13 2017, and no pen was included. I'll be asking for a return or a pen. The listing specifically says the pen is included.

Is the os on this device windows 8.1 pro or just 8.1? and is the os upgradable for win 10 later on?

My 64gb from seller DealFisher did an upgrade as soon as I started it and afterwards was Windows 10 Pro Anniversary although it stated win 8 in description. (Win10 upgrade is still available for free, too - google it)

Can ram be increased (to 6gb or 8gb) by owner?
