Cambridge University Press On the Rule of Law: History, Politics, Theory Paperback – Import, 18 November 2004

This is an excellent book on the rule of law, between the best out there. I highly recommend it for people who are interested in politics, students and political activists and for citizens in general. The rule of law is the most important concept in modern politics and the risk of losing it is ever so high in recent times.

すでに邦訳も出ていますので，内容紹介よりも評価を少し。　ブライアン･タマナハにしては，これまでの著作にみられた法社会学的・実証主義的分析手法を抑えて，哲学史・理論史的アプローチを全体的に採用している点が新鮮です。　いうまでもなく，｢法の支配｣は多義的であるとともに，論じられるコンテクストも多様です。それらをほぼ網羅的にカヴァーしているところに著者のバランス感覚の良さが窺われます。　また，各争点における著者の立場は，おおむね中道的なものであり(少なくともレヴューアーにはそのように読めます)，その意味で安心して読むことができます。逆に言えば，このコンセプトをめぐる研究のフロントラインを押し進めるような大発見は示されていません。　それでも，タマナハ独特の批判的態度は随所に光っており，彼の学説が今後大きく発展するポテンシャルを秘めていることが，ここから一種の予感として強く伝わって来ます。　各論点の掘り下げの深さが適度であり，警戒せずに手に取ることができる1冊です。

A good overview with fine references. Good starting book on the subject, leads to other writings from ancient Athens to nowadays.
